These terms of service (“Terms”) govern access to and use of the Cinemique app, published by Wincea (see legal notices). By creating an account or using the service, you accept these Terms. If you do not accept them, do not use the service.
Cinemique is a film discovery and recommendation service. It shows you films one at a time, learns from your reactions to offer personalised recommendations, lets you keep a watchlist, mark films as seen and exchange suggestions with your friends. The service is provided free of charge.
The service is accessible without registration, in guest mode with limited features, or via an account. Creating an account requires a valid email address (or a Google sign-in) and acceptance of these Terms. Using the service requires an internet connection, the cost of which remains your responsibility.
You are responsible for keeping your credentials confidential and for any activity carried out from your account. You agree to provide accurate information and not to impersonate a third party. A neutral username is assigned to you by default; you can change it at any time in the settings. If your account is used without authorisation, notify us without delay at contact@wincea.com.
When using Cinemique, you agree not to: • use the service for unlawful purposes or in breach of these Terms; • choose a username or identifier that is offensive, abusive, misleading or that infringes the rights of others; • harass, threaten or disturb other users, in particular through invitations and suggestions; • attempt to access the service, its data or other users' accounts without authorisation; • disrupt the operation of the service, overload it, or extract its data in an automated way without authorisation.
The username and profile information are freely chosen by the user, subject to the rules of use above. The publisher is not responsible for the usernames, display names and email addresses chosen by users. The publisher reserves the right to modify or remove, without notice, any username or identifier that is manifestly inappropriate, and to suspend the account concerned.
All elements of the service (brand, logos, interface, texts, code) are protected and remain the property of Wincea or its partners. Film data and images are provided by The Movie Database (TMDB); this product uses the TMDB API but is not endorsed or certified by TMDB. Nothing in these Terms grants you any right over these elements beyond normal use of the service.
We strive to keep the service available but cannot guarantee uninterrupted access. The service may be temporarily suspended for maintenance, updated, modified or discontinued, in whole or in part, without any liability on our part. Recommendations are provided for guidance only and carry no guarantee of relevance.
The service is provided “as is”, without any warranty that it is error-free or fit for a particular purpose. To the extent permitted by law, the publisher cannot be held liable for indirect damages resulting from the use of, or the inability to use, the service. Nothing in these Terms limits the publisher's liability in the event of gross negligence or wilful misconduct, nor affects the rights granted to consumers by law.
You may stop using the service and delete your account at any time from your settings. We may suspend or terminate your access, with or without notice, in the event of a breach of these Terms or manifestly abusive use. Deleting your account results in the erasure of your personal data under the conditions described in the privacy policy.
The processing of your personal data is described in our privacy policy, which forms an integral part of these Terms. We encourage you to read it.
We may modify these Terms to reflect changes to the service or the law. Significant changes will be flagged in the app and the update date at the top of this page will be refreshed. Continued use of the service after the changes take effect constitutes acceptance.
These Terms are governed by French law. In the event of a dispute, you may contact us at contact@wincea.com to seek an amicable solution. Failing an agreement, you may refer the matter free of charge to the consumer mediator whose details are set out in our legal notices. Failing an amicable resolution, the French courts have jurisdiction, subject to the mandatory rules protecting consumers.
